                NOTE

Normall, HLS will get your
Special Proceeding ["SP"]
petition drafted and filed the
same day. The Hawaii court
may take 4 to 10 days to
review the SP petition and sign
the order directing the court
clerk to allow issuance of your
subpoena.

If time is an issue there is the
option of moving the Court ex
parte to shorten time to hear
your SP Petition. ($175.00).  

If time is an issue, please be
ready to pdf or fax your
documents to HLS.
                                     SUGGESTIONS

Please consider the following suggestions to help you get records on time and at a minimum
of costs.

1.   If your jurisdiction permits. Consider, in lieu of the Records Custodian physically go to and
appearing at the records deposition, set a mail-return date 3 to 5 days before the scheduled
records deposition date for the records custodian to mail you the records attested to as true
and correct copies of the records subpoenaed.  Most Records Custodian do not want to take a
1/2 a day to physically appear at a deposition and may quickly opt to produce the records via
mail.

2.   Include a coverletter from your office to be delivered with your subpoena, clearly describing
     ---  the record under subpoena (try not to write the coverletter like a lawyer)
     ---  list a contact name at your office with a direct telephone number (include extension #)
           and an email address.
     ---  Importantly, invite the Record Custodian to call or eMail your office with questions.

3.   Include a form to the Records Custodian (served with subpoena) that encourages the
Record Custodian to use the form as a convenient way to authenticate the records being
produced (if possible avoid forms needing notary) see sample

Records)

4.   Include a SASE envelope (i.e., US Priority envelope, FedEx box)  with the served subpoena
duces tecum for the Record Custodian to opt using using instead of physically appearing at a
record deposition.   

The point here is that you want the records and the Record Custodian has the records you
want.   and your subpoena duces tecum is a pain-n-the-ass of the Record Custodian.  Use
some sugar!  Some aloha!  And, dont be shy or arrogant in the coverletter.
